Consumer Confidence in the CBD Industry
The CBD industry is evolving with more and more structure. The more regulation and quality control, the more testing and research, the more consumers will trust our products. Consumers are listening. It is our responsibility to live up to our promises.
The FDA has not started supplying structure or regulation. So, currently, a lot of regulation and quality control comes from within. For instance, here at BDX, we not only send our products for 3rd party testing, we also test our products in-house. Farmers, extractors, and brands are responsible for checking themselves to ensure low quality products don’t make it to consumers.
Not everyone is on the same page
As an industry, we are constantly improving due to the hard work of many great companies. However, not every company is driving the industry forward or helping build consumer confidence. That is why we need help from the FDA. With a decision around CBD, regulation, and guidelines, we can ensure that everyone falls in line.
Every once in a while, we hear stories about CBD brands selling products with low CBD potency or, worst of all, no CBD at all. That actually happened recently in Massachusetts. Problems like this will not be quickly forgotten by consumers. Without FDA guidance, courts and consumers alike do not know what to do.
The case has been delayed
“Pending forthcoming FDA regulations on the products at issue.” Judge Allison D. Burroughs issued a ruling Tuesday, saying that a lawsuit against a CBD maker alleging incorrect labeling will be delayed awaiting FDA guidance.
The judge denied their appeal to dismiss the case. The defendant, a Florida-based CBD company, is accused of selling CBD with “either no amount of the challenged ingredients, or amounts too low to have any pharmacological effect.”
The lawsuit also points out that the U.S. Food and Drug Administration “has not legalized CBD for sale as a supplement.”
Burroughs noted there are three similar lawsuits where other district courts have also stayed the case pending FDA regulations. It’s unclear when those regulations are coming.

So, what’s the timeline?
Recently, on July 22nd, we reported that the FDA sent a guidance document to the White House Office of Management and Budget. Since then, multiple entities have met with the White House regarding CBD and its future standing with federal regulation. As details surrounding these meetings are released, we should start to know more. We will keep you up to date!
